  1. Terms and Conditions

  funydev.com may change the Terms and Conditions, partly or in whole, at any time, and those changes will be effective upon posting them to the site. By using our website, you agree to these terms.

  2. Trade Marks

  The owners of the rights to the materials published on this site retain those rights.

  3. Developers Terms and Conditions

  All uploaded materials will be visible on the web, except for paid files, which will become visible to buyers who purchase your code. By clicking ‘submit’ and upon approval of your product on this site, you accept the terms and conditions and enter into a legal agreement with funydev.com. If you are submitting files and content on behalf of your company, you declare that you have the legal authority to do so and to bind your company to this agreement. You also state that you are at least 18 years old.

  4. Developers

  funydev.com reserves the right to:

  • Not grant you a developer account.
  • Suspend your account at any time without notice.

  funydev.com is not obliged to provide reasons for rejecting your account request or suspending your account. You are solely responsible for all access and use of the site with your username and password. If there is any unauthorized use of your login details, you must notify funydev.com immediately.

  5. Copyright Infringements and DMCA Takedown Notices

  If you believe there has been a copyright violation of your products, please email this information to [email protected]. Include the following in your email:

  • Your name, address, email
  • If you are a business, your business name and address
  • A link and explanation of the copyrighted materials
  • Proof that you own the copyrighted material

  We will investigate your report and may request more information to proceed with the inquiry.

  DMCA Takedown Notices

  With each product you submit to the funydev.com marketplace, you agree to our terms and conditions, granting us full power of attorney to file DMCA takedown notices on your behalf. We do this when you report that a listing/infringement of your work is found on another website that you didn’t approve for sale. We will file these DMCA takedown notices on your behalf as your representatives.

  6. funydev.com’s Role

  The developer is the sole owner of the codes he/she lists on this site, and funydev.com has no ownership or usage rights to the uploaded codes. funydev.com does not control and is not responsible for the quality, legality, or safety of the content or codes sold and downloaded from this site. funydev.com gives no guarantee that any of the materials on the site do not infringe on the intellectual property of others. If you suspect a copyright infringement, you can submit it in accordance with section 5 of this agreement.

  7. Site Usage and Maintenance

  funydev.com reserves the right to partially or fully stop access to the site for you or shut down the site entirely. The site may be down for maintenance at funydev.com’s sole discretion without prior notice. funydev.com will not be liable for any loss caused by these actions.

  8. Fees and Services

  Registering as a buyer or developer on the site is free. Buyers pay for the products they choose to purchase. If a buyer is located in Europe and purchases privately (not for a company), VAT will be added per MOSS VAT laws. As a developer, you will be paid a commission for each product sold. Buyers can purchase using credit cards and cryptocurrency. Developers get paid via PayPal or Payoneer. Developers shall pay all fees and costs necessary for the payout of their commissions.

  9. Developers Credibility of Information

  By applying to become a developer on this site, you declare that all details you provide about yourself and your business are 100% correct and updated.

  10. Security and Privacy

  funydev.com does not guarantee the security of your data and any materials uploaded to this site. We maintain our own security mechanisms to protect the data on the site.

  11. Payments

  Payments of earnings will be made as follows:

  • There is a threshold of $100 that needs to be met to request a payout.
  • Payouts will be made using PayPal or Payoneer.
  • If earnings are less than $100, the payout will occur 120 days after the last purchase on the developer’s account.
  • Developers shall pay all fees and costs necessary for the payout of their commissions.
  • You allow funydev.com to automatically deduct amounts for refunds, chargebacks, and unauthorized transactions from your commissions.
  • If a buyer requests a refund within 30 days due to product issues (not as described, code broken, etc.), you automatically grant the buyer a full refund if the buyer’s claim is valid per our refund policy.

  12. Purchasing Products

  Orders made on this site cannot be canceled. If you believe there is a special reason for a refund request that does not meet our refund policy definitions, you can email your request to [email protected]. funydev.com reserves the right to reject your refund request if it does not meet our refund policy.

  13. Selling Products

  As a developer, you guarantee to funydev.com and buyers that your products:

  • Are fully owned by you, including intellectual property rights.
  • Do not infringe copyrights or intellectual properties of others.
  • Are not stolen.
  • Are not harassing or unlawful in any manner.
  • Are suitable for users under 18 and do not contain pornographic or malicious content.
  • Are free of any spyware, malware, or malicious code.
  • Do not lead to termination of service from an ISP.
  • Do not violate any state laws.

  13.1 Additional Terms for Selling Your Products on Our Site

  • All products on this site are first reviewed by the funydev.com team.
  • funydev.com is not obligated to approve your product listing and may reject it without providing reasons.
  • If your product violates the terms and conditions, funydev.com can suspend your account. Earned money will be returned to you only after dispute resolution. If there is sufficient proof of a violation, funydev.com may deny stored commissions.
  • We reserve the right to edit and change prices and content at our discretion.
  • We reserve the right to remove any listed item without notice and without obligation to state reasons. No refunds will be given for losses claimed due to product removal.
  • funydev.com is not responsible for how buyers use your products.
  • Your product(s) and creative content may be used in promotional and marketing materials to promote the site.
  • The minimum listing time for approved items is 9 months from approval.
  • During the listing period, you may list your items on other marketplaces but cannot grant exclusivity to other marketplaces for items published during this period.
  • For removal requests due to signing exclusivity with other marketplaces, the agreement with funydev.com will be followed.

  14. Disclaimer

  funydev.com does not exclude any non-excludable rights but excludes all other conditions and warranties implied by custom, law, or statute. Except as provided by the non-excludable rights:

  • All content, materials, and products on this site are provided "AS IS" and without warranties of any kind.
  • funydev.com does not guarantee the site is free of errors or that the server hosting the site is free of viruses or other harmful components.

  15.  Commissions

  • As a developer, you approve funydev.com to subtract its commission from each sale.
  • Commissions might change according to agreements.
  • Developers receive a commission of 60% for each code sold.
  • Developers are eligible for commissions only from selling their source codes. Other services provided by funydev.com, such as reskin jobs, graphic designs, etc., belong solely to funydev.com.
  • Commission fees for each sold product are determined by funydev.com and may change.

  16.  Prohibited Conduct

  You warrant that when using the site and its services you will not:

  • Use a false email address or data.
  • Insert your own or a third party’s advertising and use the service for any further commercial or promotional purposes.
  • Engage in spamming, flooding, harvesting of email addresses or other personal information, spidering, “screen scraping,” “database scraping,” or any other activity to obtain lists of users or other information, or send chain letters or pyramid schemes via the Site; or attempt to gain unauthorized access to other computer systems through the Site. You agree not to use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site.

  funydev.com reserves the right to determine at its sole discretion if there was a breach of these terms and to suspend your account without notice or explanation.

  17. Forums

  You are responsible for any materials you post on the site. We reserve the right, but are not obligated, to edit, review, and modify the materials you post. funydev.com reserves the right to block and delete content that violates our terms or uses violent or offensive language.

  18. Indemnification

  You will be solely liable and responsible for any direct and indirect claims and expenses (including legal fees) arising from the following:

  • Any product you have uploaded to the site.
  • Your usage of the site.
  • Any content, graphic materials, or files you have uploaded to the site.
  • Any breach of the terms and conditions in this agreement.

  20. Jurisdiction

  Jurisdiction for any dispute is the Court of Dublin, Ireland.

  21. Definitions

  In these Terms and Conditions:

  • Developer means a person who applied to become a developer on funydev.com, filled out a form with their details, and agreed to the terms and conditions.
  • Buyer means a person or a company that bought a product or service on this site.
  • We or us means funydev.com.
  • Our site and this site mean funydev.com.
  • You or your means developer or buyer.
